Terms of Service

Welcome to the Elite Project Controls System. These Terms of Service ("Terms") govern your purchase and use of the digital products, tools, dashboards, and AI prompt libraries (collectively, the "System") provided by Eliwa Project Controls Limited ("we," "us," or "our").

By purchasing or using the System, you agree to be bound by these Terms. If you do not agree, please do not purchase or use the System.

1. Digital Product License

Upon successful payment, Eliwa Project Controls Limited grants you a non-exclusive, non-transferable, perpetual license to use the Elite Project Controls System for your individual professional use or within your specific project environment.

  • Permitted Use: You may use the templates, dashboards, and tools to manage your projects, generate reports for stakeholders, and analyze project data.
  • Prohibited Use: You may not resell, lease, sublicense, redistribute, or share the source files (Excel, Power BI, PDF, or text-based AI prompts) with third parties or on public repositories. You may not use the System to create a competing product.

2. Payments and Delivery

  • Payment Processor: All payments are processed securely through PayPal. We do not store your credit card or financial information.
  • Pricing: The "Launch Price" of $179 is a limited-time offer. We reserve the right to change the price at any time without prior notice.
  • Delivery: Upon confirmation of payment via PayPal, you will receive an email with instructions on how to access/download the digital files.

3. Professional Confidence Guarantee

We offer a 30-day "No Questions Asked" refund policy.

  • If the System does not meet your professional requirements, contact us at hassan.eliwa@eliwa.co.nz within 30 days of purchase.
  • Refunds will be processed back to your original PayPal account.
  • Upon refund, your license to use the System is immediately revoked, and you must delete all copies of the files in your possession.

4. Intellectual Property

The System, including its logic, design, formulas, and AI prompt structures, is the intellectual property of Eliwa Project Controls Limited and Hassan Eliwa. It is protected by copyright and international intellectual property laws.

5. Disclaimer of Results

While the System is built based on 20+ years of infrastructure experience and PhD-level research, project outcomes depend on various factors beyond the System's control.

  • The System is a decision-support tool, not a guarantee of project success.
  • We are not liable for any financial losses or project delays resulting from the use or interpretation of the data within the System.

6. AI Prompt Library Usage

The AI Project Controls Assistant (Module 9) provides prompts for use with third-party LLMs (like ChatGPT or Claude). We are not responsible for the accuracy or performance of these third-party AI models.

7. Limitation of Liability

To the maximum extent permitted by law, Eliwa Project Controls Limited shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you for the product.

8. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of Auckland, New Zealand.
